JOB DESCRIPTION

- Conducts legal assessment on the Incident Report submitted to LR and drafts the necessary Notice to Explain to start the administrative case processes.
- Closely monitors the administrative case processes and ensures that the timelines are within the SLA prescribed by CLR.
- Conducts Administrative and Clarificatory Conferences, and drafts the necessary CLR Case Report and Recommendation, and the subsequent Notice of Decision with the approval of the Head of Labor Relations.
- Represents MIESCOR in various labor-related proceedings such as SEnA, Mandatory Conference before the Labor Arbiters, DOLE, and the likes; and makes active participation therein through negotiations and/or settlement of cases.
- Provide support for all Labor Relations concerns of MIESCOR's subsidiaries.
- Handles the implementation of labor relations policies, programs, and activities.
- Manages the compliance of management and employees with labor laws and standards and to the company's Code of Conduct.
- Attends to inquiries pertaining labor relations.
- All other functions as may be tasked by the Heads of Corporate Labor Relations or Labor Relations.

- Graduate of Juris Doctor degree (preferably a new member of the Bar)

JOB SUMMARY:

(2) Gives testimonies as Company Representative and recommendations / insights to Internal/ External Legal Counsel on the case,

Also provides advice on Employee Discipline and implementation of the Code of Conduct, Handling of Grievances,, and Handling of Arbitration, Conciliation and Mediation. As such, he acts as Chairman of CBA Negotiations, the Labor Management Committee and Investigation Committees.
Specific Duties and Responsibilities:
Labor Relations:
- Develops the Labor Relations Program of the Group which will guide all Plant Managers in dealing with the Labor Unions in order to maintain Industrial Peace within the Plants at all times.
- Provides advice to the COO's, Functional Heads, Plant Managers and Branch Managers on all aspects of Labor Relations to include Employee Discipline, and Handling of the Grievance Machinery, Arbitration, Conciliation and Mediation with the Labor Union.
- Attends to employee grievances in the plant and regularly communicates with the local labor union in order to maintain harmonious working relations between Management and the Labor Force.
- Coordinates with the Federation and the Union Officers during the renewal of the CBA.
- Spearheads CBA negotiations and arranges logistical requirement of meetings.
- Acts as Point person for all Labor Cases of the Group to include attending Labor Hearings, Giving testimony as Company Representative, and monitoring of the Status of all Labor Cases until resolution.
- Maintains close coordination with Internal & External Lawyers, ensuring that the interest of the Company is well protected at all times.
- Maintains files for all Labor Cases and updates these regularly.
- Prepares reports on the Status of labor Cases for submission to the EXCOM or the Chairman & CEO.
- Represents the Company in Labor Management Committee Meetings.
- Represents the Company during DOLE inspection and ensures that all reportorial requirements of DOLE are submitted on time.
- Regularly monitors national and local proclamations, Minimum Wage Orders, and/or DOLE advisory and ensures that these are implemented.
- Assists all Functional Heads in the area of Employee Discipline and implementation of the Code of Conduct.
- Participates in formal investigations pertaining to violation of the Code of Conduct.
- Documents all Personnel Movements and ensures that these comply with Company Policies.
- In coordination with Legal Counsel, ensures that all employment contracts and documentations of personnel movements are in compliance with the Labor Code.
QUALIFICATION:
- At least 20 years of work experience in the management of Labor Relations/ Employee Relations Functions specifically in the monitoring/management of Labor Cases, CBA Negotiations and dealing with Labor Unions, Employee Discipline and Implementation of the Code of Conduct and in managing Plant Personnel & Admin.
- Must have a good network with the DOLE (NLRC/NCMB) and the Labor Union / Federations.
